Guardians of Piracy

I am a writer myself and I know where you're coming from. However, as writer who has published most of his works in the internet, I have long accepted the sad and unfortunate fact that someone can and will copy and share work my without my permission.

Nakakalungkot mang sabihin para sa mga original online writers or bloggers tulad natin, pero di natin pwedeng i-claim na copyright infringement yon. In the first place hindi pa yon copyrighted. Masasabi lang nating copyrighted ang isang bagay kung dumaan ito sa ligal na pamamaraan ng pag-copyright. Kung may maipapakitang copyright documents ang author dun lang natin masasabi na valid yung claim nya ng copyright infringement. Ang pagkakaroon ng drafts ay hindi sapat na ebidensya na tayo ang gumawa non, pwedeng kinuha lang natin yon sa room mate natin o kapatid o kaibigan o kanino man.

More importantly, (name of forum withheld for now) is a sharing site. Hindi talaga natin mapipigilan yung members kung ano yung i-share nila sa site and as of this time, halos 1k downloads na yung nakikita ko sa attachment. Kahit burahin natin ngayon yung thread, what's going to stop the other 1k from posting it again in (name of forum withheld for now) or in any other site? We also have very little control sa mga inilalagay sa site lalo na kung publicly available na yung content sa internet in the first place.

And lastly, walang nilabag na rules ng Symbianize yung mga nag share. Hindi naman kasi nila inangkin yung e-book or sinabi na sila ang gumawa. Papatawan lang natin sila ng parusa kung inangkin nilang kanila ang akda na iyon.

So unless you can give us documentary proof of a legal copyright claim, the thread stays open.


Do you think this kind of reasoning is valid to justify piracy?

I did file a complaint, the first step is to exhaust all efforts to communicate with the culprit and then host site. All writers who have filed legal actions and complaints know that. IPOPHIL and the rest would tell you to do.

If that fails then you have to show proof that you tried everything to settle the problem amicably. That is when you start filing the fomal complaint and attach the proof of your communication with the host site.

So porke 1k na naka download sa file okay na? Ganon nalang yon? Imbes na kayo gumawa ng paraan para makatulong hahayaan nalang kasi 1k naman na e. Tapos irarason pa na ano magagawa mo kung ipost ulit dito? 

If you kind sir are in the right state of mind then of course you and the admins will see to it that it shall never be posted again. No control of what is being posted? Or let it happen to have more members?

and now it is my burden to show you proof? No thanks, let the proper authorities show you that later. I did communicate kindly, requested kindly, why should the burden of proof fall against my shoulders when you can clearly see in that thread, that selfish person even has admitted in the title "PAID"

He is extracting chapters from a "PAID" item. He has knowledge it is illegal, he flaunts "PAID" in the title. And now you give me that kind of reasoning? 

Posted online? Are you serious? Did you even read complaint? It is an e-book, an e-book that is being sold. If you read the complaint, that blog post was only the advertisement to the said e-book. 

And you come saying as a fellow writer...did you even read the complaint? So you say it stays open until i show proof. Will you read the proof i send you?
